Creditors' Prehearing Remedies and Due Process

Abstract

Recent decisions of the United States Supreme Court have substantially reduced the prehearing remedies available to secured creditors in the event of default. The author examines the constitutionality of "self-help" repossession as set forth in state enactments of section 9-503 of the Uniform Commercial Code.
