Municipal Self-Determination: Must Local Control of Growth Yield to Travel Rights?

Abstract

Municipalities in several areas of the country, concerned about the problems which accompany rapid growth, have enacted ordinances aimed at limiting or controlling municipal growth. The writer explores the vulnerability of such ordinances to constitutional attack based on the right to travel, and applying the principles developed to specific growth control measures.
