Subsidence: An Emerging Area of the Law

Abstract

The withdrawal of groundwater from underground aquifers for man's various activities often causes the land surface to sink. The damage caused to land and fixtures unowned by the pumper should be redressed under legal theories relating to loss of subjacent support and not under general water law.
