A Legislative Proposal Protecting Riparian Vegetation, an Endangered Habitat—An Unconstitutional Taking?

Abstract

Arizona's riparian habitat, with its potential for aesthetic, recreational, and wildlife uses, is being destroyed by modern civilization. The author proposes a statute protecting this habitat, and addresses arguments that such a statute would be an unconstitutional taking.
