Eighth Amendment Proportionality Analysis: The Limits of Moral Inquiry

Abstract

The doctrine of proportionality requires that a criminal penalty be proportionate to the severity of the crime. This Note suggests an extended eighth amendment analysis which will provide a more refined standard of review for criminal sentences.
