Discharging Student Loans in Bankruptcy: The Bankruptcy Court Tests of "Undue Hardship"

Abstract

This Note addresses the problem of discharging student loans in bankruptcy. The author examines both the scope and the source of the problem and concludes that the tests employed by a majority of the courts are unrealistic because they are based on the no longer tenable assumption that education is an inherently valuable asset.
