Defining State Law According to State Court Results: The Arizona Contributory Negligence Rule in Federal Torts Claims Act Cases

Abstract

This Note addresses the issues raised by Arizona's unique contributory negligence rule in Federal Tort Claims Act cases. The author argues that Arizona's federal courts should adopt the Arizona contributory negligence rule in FTCA cases despite the absence of a jury. In an addendum the author considers the effect that the new comparative negligence legislation will have on this question.
