Compliance Strategies for Draft Registration

Abstract

Authors Jacob and Travis analyze the continuing problems with enforcing the draft registration law. The authors recommend abolishing face-to-face registration and, if registration becomes necessary at all, adopting a passive computer registration. Alternatively, the authors argue for indicting all young men informing the government of their intention not to register, along with a small number of "silent" violators randomly selected from the known violators list. Professor Jacobs and Mr. Travis suggest that indicted individuals not be allowed to cure their criminality by late registration. The authors recommend that the Justice Department adopt a uniform sentencing approach and recommend it to sentencing judges.
