Big Macs and Radio Shacks: Antitrust Policy for Business Format Franchises

Abstract

Fast food and other variants of business format franchises present unique problems for antitiust law enforcement. While franchise agreements are facially and potentially anti-competitive, they also facilitate an unqualified marketplace success. Professor Strasser argues that courts must, therefore, supervise anti-competitive restrictions while not interfering with the basic franchise arrangement.
