Eighth Amendment Challenges to the Length of a Criminal Sentence: Following the Supreme Court "from Precedent to Precedent"

Abstract

The authors analyze recent Supreme Court decisions regarding the proportionality of criminal sentences. Their reconciliation of constitutional values suggest a new theory of decision, which is consistent with the history and tradition of the eighth amendment.
