The Erosion of Legality in American Criminal Justice: Some Latter-Day Adventures of the Nulla Poena Principle

Abstract

Professor Allen describes the erosion of the principle of nulla poena sine lege by the trend toward broadened judicial interpretations of legislative intent. This article examines the consequences of this erosion and argues that a return to the tradition of strict interpretation by the judiciary will prevent further weakening of this important principle.
