Victims in the Criminal Process: A Utilitarian Analysis of Victim Participation in the Charging Decision

Abstract

Professor Welling examines the costs and benefits of granting crime victims the right to participate in charging decisions. She argues that the public benefit of allowing victims this right outweighs the detrimental effects of the participation, but she warns that such participation must be carefully structured.
