The Separation of Powers Cases: Not Really a Mess

Abstract

The scope of the doctrine of the separation of powers is examined in light of some recent Supreme Court decisions. Mr. Stern argues that the functions of the three branches often overlap and that most commingling of functions should be upheld, absent an encroachment at the expense of another branch.
