Pre-Arrest Delays and the Right to Speedy Arrest: Apologia Pro Vita Ross

Abstract

Defending application by Ross v. United States of fifth amendment due process to control governmental delays before arrest, the author analyzes the limited acceptance of the Ross decision and compares sixth amendment speedy trial control of post-arrest governmental delays. The principles behind Ross are examined and the law which has subsequently emerged is detailed.
