Indemnification of a Nuisance Defendant for Costs Incurred by Complying with an Injunction

Abstract

The Supreme Court of Arizona recently required a successful nuisance plaintiff to indemnify the defendant for the costs incurred in complying with an injunction. The writer examines several legal theories which might support the result reached by the court and the possible future application of the indemnification remedy.
