Sovereignty, Citizenship and the Indian

Abstract

The unique position of the Indian in the American political and constitutional scheme has often been used to justify the formulation of federal Indian policy without regard to obvious constitutional conflicts. Reviewing American ideological tenets and applying basic concepts of sovereignty and citizenship, the writer develops a theory regarding the proper constitutional status of the Indian.
