Protecting the Buyer of Previously Encumbered Goods: Another Plea for Revision of UCC Section 9-307(1)

Abstract

The author examines the failure of Uniform Commercial Code section 9-307(1) to protect the innocent marketplace buyer of goods against unknown security interests in those goods created previously by persons other than the seller. Other situations in which the buyer is protected against outstanding interests are discussed and reasons for extending this protection are suggested.
