Screening Travelers at the Airport to Prevent Hijacking: A New Challenge for the Unconstitutional Conditions Doctrine

Abstract

Analyzing airport antihijacking procedures in light of the unconstitutional conditions doctrine, the author concludes that existing screening methods do not provide the least drastic means of protecting air travel. A model screening procedure which provides a less drastic alternative to the current system is proposed.
