Jurisdiction and Waiver

Abstract

Contemporary juvenile courts are authorized to exercise broad control over children who require court supervision. In the first part of this section, the nature and extent of the jurisdiction exercised by the juvenile court will be explored, and proposals for modifications will be set forth. In the second part, the power of the juvenile court to waive its jurisdiction over a child and remand him for trial in the criminal court will be analyzed. This will include a discussion of the standards for waiver of jurisdiction provided by the Arizona Rules of Procedure for the Juvenile Court [Juvenile Rules] and an assessment of the criteria used to meet these standards. Finally, the consequences of a waiver hearing will be discussed.
