Psychotherapists' Liability for Extrajudicial Breaches of Confidentiality

Abstract

A psychotherapist's breach of his patient's confidentiality detracts from the trusting relationship required for successful psychotherapy. The author explores several theories of recovery against a psychotherapist who breaches his confidentiality so that such conduct may be deterred and the patient compensated for his loss.
