Reclamation of Strip-Mined Federal Land: Preemptive Capability of Federal Standards over State Controls

Abstract

The issue of control and jurisdiction over reclamation of strip-mined federal land is examined in the context of emerging federal-state energy development conflicts. After examination of appropriate constitutional doctrines, the author concludes that federal regulations should not preempt the state's interest in lands within its borders.
