Abstract
This Note examines the scope of the state police powers to proscribe those acts which cause no tangible, direct harm to others. Both philosophical and constitutional arguments are presented to justify the position that society may not deprive the individual of the liberty to make the decision to do those acts which affect himself most directly and others only tangentially.
