First Amendment Proscriptions on the Integrated Bar: Lathrop v. Donohue Re-Examined

Abstract

The establishment and organized activities of the integrated bar raise significant constitutional issues regarding the first amendment rights of member attorneys. The author analyzes the state interests and the individual rights at stake, points out those aspects of bar integration and operation that are unconstitutional, and suggests various remedial mechanisms available to member attorneys.
