Equal Protection and the Search for Justice

Abstract

The concepts of justice and equality lie at the heart of the equal protection clause. In examining the Bakke decision, the author argues that in pursuing justice, a society must do more than simply pursue equal treatment of its citizens. Rather, the notion of justice encompasses additional values.
