The Erie Enigma: Appellate Review of Conclusions of Law

Abstract

This Essay challenges the Ninth Circuit's recent decision in The Matter of McLinn permitting de novo appellate review of district court state law determinations. Suggesting that this litigation burden is more appropriately placed on state courts, Professor Woods advocates a greater reliance on certification procedure.
