Toward New Standards for the Neutral Lawyer in Mediation

Abstract

This Article examines mediation as an alternative method of resolving disputes. The author focuses on the lawyer's role in mediation and the potential problems that can arise as a result of the lawyer's participation. Professor Riskin concludes that the effectiveness of neutral lawyering would be enhanced by the development of fairness and maximization standards.
