Imposing a General Survival Requirement on Beneficiaries of Future Interests: Solving the Problems Caused by the Death of a Beneficiary before the Time Set for Distribution

Abstract

Professor French's Article addresses whether state legislatures should abrogate the venerable preference for indefeasibly vested future interests by imposing a statutory requirement of survival. The author concludes that legislators should abrogate the preference, but only if a satisfactory substitution of beneficiaries is provided for by statute.
