Fraud in the Adoption Setting

Abstract

Comment: Torts
This Comment examines the fraud action in Arizona in light of the Burr decision. It considers the potential liability of the state, of state agents, and of private adoption agents for false representations made to adopting parents. The potential liability of these parties for nondisclosure is also discussed, in light of both the duty to disclose imposed by state statute and the arguably fiducial nature of the relationship between the adoption agent and the adopting parents.
