Risk-Utility Analysis and the Learned Hand Formula: A Hand That Helps or a Hand That Hides?

Abstract

Professor White defends the cost-benefit technique as an adjudicatory process with roots in legal jurisprudence and not a derivitive of economic theory. She argues that while the cost-benefit technique itself is value neutral, its application invokes a moral dilemma.
