Abstract
This Note explores the extent of manufacturers' post-sale duties.Particularly, the paper addresses whether manufacturers have a duty to retrofit their products. The Note outlines seminal post-sale duty case law and analyzes recent case law addressing the issue. Ultimately, the author determines that Arizona courts may impose upon manufacturers a duty to retrofit their products in certain, albeit limited, circumstances.
