Abstract
While agreeing with Professor Nagel that the practical effects of the disagreements in the Term Limits case are small, Professor Tushnet argues that the rhetoric of Justice Thomas' dissent rejects important elements of our constitutional commitment to universalism that can be found in the Declaration of Independence and the speeches of Abraham Lincoln.
